Smt. Pooja Vs The Principal Judge Family Court & Another
Allahabad High Court (Single Judge)
MATTERS UNDER ARTICLE 227, 3637 of 2015, Judgment Date: Jul 24, 2015
Case :- MATTERS UNDER ARTICLE 227 No. - 3637 of 2015 Petitioner :- Smt. Pooja Respondent :- The Principal Judge Family Court & Another Counsel for Petitioner :- Pankaj Govil Hon'ble Manoj Kumar Gupta,J. The only prayer made in the petition is for a direction to the trial Court to decide the Divorce Petition No. 653 of 2014, within a stipulated time. A perusal of the record reveals that the petition has been filed by the petitioner seeking divorce. On 26 May 2015, the Court directed the plaintiff to take steps for service on the defendant by both the modes. Therefore, there is nothing on the record to indicate that the respondent has been served. Section 21-B of the Hindu Marriage Act specifically provides that all proceedings under the Act should be held on a day to day basis and effort should be made to conclude the proceedings as far as possible within six months from the date of service of the petition on the respondent. In view of the aforesaid provisions under the Act, I am of the opinion that no further direction is required. The petition is accordingly disposed of. (Manoj Kumar Gupta, J.) Order Date :- 24.7.2015
