Shaista Khan Vs The State Of Madhya Pradesh
Madhya Pradesh High Court (Division Bench (DB)- Two Judge)
WRIT PETITION, 3052 of 2015, Judgment Date: Jun 25, 2015
WP-3052-2015
(SHAISTA KHAN Vs THE STATE OF MADHYA PRADESH)
25-06-2015
Mr. K.N. Agrawal, learned counsel for the petitioner.
Mr. Swapnil Ganguly, learned Government Advocate for the
respondents/State.
Petitioner was a candidate, who had participated in the process
for selection to course of Bachelor of Unani Medicine System First
year for the academic session 2014-15. On account of various
facts, it is said that the petitioner was not granted admission,
which is illegal and contending that two seats are still vacant, this
writ petition has been filed on 26.02.2015. It is well settled
principle of law that for admission in the professional institute, no
directions or admission can be granted after 30th September of the
academic session in question and that being so, after 30th
September, 2014, the law prohibits us from interfering in the
matter.
Keeping in view the aforesaid, we see no ground to interfere now
merely because the seats are lying vacant. The petitioner, if had
any grievance should have ventilated it much before 30th
September, 2014. This having been not done, indulgence in the
matter cannot be made. The petition is therefore, dismissed.
