The petitioner, who is defendant No. 3 in Original Suit No. 963 of 2004,
has filed the instant petition for a direction to the trial Court to decide the
suit, within a stipulated time.
A perusal of the order sheet reveals that the suit is at the stage of trial.
The issues in the suit were framed long back. However, the proceedings
are being delayed on one ground or the other.
Considering the facts of the case and submissions made, this petition is
disposed of with a direction to the trial Court to make all endeavour to
decide the suit expeditiously, without granting unnecessary
adjournments to any of the parties.
