WP-7084-2015 (POOJA DWIVEDI Vs M.P. PUBLIC SERVICE COMMISSIONER INDORE) 26-06-2015 Shri Harish Agnihotri, learned counsel for the petitioner. Considering the fact that the main examination for the Public Service Commission Examination 2013 is already over, now after the examinations are over, on account of lapses on the part of the Public Service Commission in committing the mistake in declaring preliminary examination's result of the petitioner and the consequential effect of the petitioner being denied the opportunity to appear in the main examination, no indulgence can be made by this Court exercising jurisdiction under Article 226 of the Constitution. This Court cannot now direct the Public Service Commission to hold a separate examination for the petitioner, as the main examination is already over. At best, if the petitioner feels that the he has put to loss because of the negligence on the part of the respondents, he may claim damages in accordance with law by initiating fresh proceedings as may be applicable under law. With the aforesaid, finding no case made out for any further indulgence into the matter, the petition stands disposed of. (RAJENDRA MENON) JUDGE (VANDANA KASREKAR) JUDGE
