The petitioner is defendant in Original Suit No. 114 of 2004. The suit has
been instituted by the second respondent for permanent prohibitory
injunction.
It is submitted by learned counsel for the petitioner that the hearing has
already commenced and the evidence of the plaintiff's witnesses is
being recorded.
The only relief claimed in the writ petition is for a direction to the trial
Court to decide the suit within a stipulated time.
Considering the submissions made and regard being had to the facts of
the case, this petition is disposed of with a direction to the trial Court to
make all endeavour to decide the Original Suit No. 114 of 2004
expeditiously, without granting unnecessary adjournments to any of the
parties.
