Although several reliefs have been claimed in this petition, but the
only relief pressed by learned counsel for the petitioner is for a
direction to the trial court to decide the application for temporary
injunction pending in Original Suit No.400 of 2015 instituted by
the petitioner, within a stipulated time.
A perusal of the record reveals that the suit has been filed by the
petitioner for permanent prohibitory injunction. The application
for temporary injunction is pending before the trial court and
notices were issued to the defendants. According to learned
counsel for the petitioner, the next date fixed for disposal of the
temporary injunction application is 21.8.2015. However, it is not
clear from the order sheet whether the defendants have been
served or not.
In such view of the matter, this petition is disposed of with
direction to the trial court to make all endeavour to decide the
application for temporary injunction expeditiously by fixing short
dates, after ensuring that the service on the defendants has been
effected.
