The petitioners have instituted Original Suit No. 697 of 1994
against the defendants/respondents for permanent prohibitory
injunction.
A perusal of the order sheet reveals that though issues were framed
a long time back in the year 1995, but even then the plaintiffs
evidence has not commenced. The petitioners have now
approached this court for a direction to the trial court to decide the
suit within a stipulated time frame.
Since, the petitioners themselves are plaintiffs in the suit and their
evidence has yet not started and therefore, I do not find it a fit case
for issuing any direction, as sought for in the writ petition.
However, it is always open to the petitioners to approach the trial
court and impress upon it the urgency in getting their evidence
recorded without any further delay.
With these observations, the petition stands disposed of.
