5. प्रस्थापनाओं और प्रतिग्रहणों का प्रतिसंहरण -- कोई भी प्रस्थापना उसके प्रतिग्रहण की संसूचना प्रस्थापक के विरुद्ध सम्पूर्ण हो जाने से पूर्व किसी भी समय प्रतिसंहृत की जा सकेगी, किन्तु उसके पश्चात् नहीं।
कोई भी प्रतिग्रहण उस प्रतिग्रहण की संसूचना, प्रतिगृहीता के विरुद्ध सम्पूर्ण हो जाने से पूर्व किसी भी समय प्रतिसंहृत किया जा सकेगा, किन्तु उसके पश्चात् नहीं।
दृष्टान्त
क' अपना गृह ‘ख’ को बेचने की प्रस्थापना डाक से भेजे गए एक पत्र द्वारा करता है।
‘ख’ प्रस्थापना को डाक से भेजे गए पत्र द्वारा प्रतिगृहीत करता है।
‘क’ अपनी प्रस्थापना को 'ख' द्वारा अपने प्रतिग्रहण का पत्र डाक में डाले जाने से पूर्व किसी भी समय या डाले जाने के क्षण प्रतिसंहृत कर सकेगा, किन्तु उसके पश्चात् नहीं।
‘ख’ अपने प्रतिग्रहण को, उसे संसूचित करने वाला पत्र ‘क’ को पहुँचने के पूर्व किसी भी समय या पहुँचाने के क्षण प्रतिसंहृत कर सकेगा, किन्तु उसके पश्चात् नहीं।
5. Revocation of Proposals and acceptance -- A proposal may be revoked at any time before the communication of its acceptance is complete as against the proposer, but not afterwards.
An acceptance may be revoked at any time before the communication of the acceptance is complete as against the acceptor, but not afterwards.
Illustrations
A proposes, by a letter sent by post, to sell his house to
B accepts the proposal by a letter sent by post.
A may revoke his proposal at any time before or at the moment when B posts his letter of acceptance, but not afterwards.
B may revoke his acceptance at any time before or at the moment when the letter communicating it reaches A, but not afterwards.
