Section 29 - Amendment of Ordinance 38 of 1944 .-

In the Criminal Law Amendment Ordinance, 1944 ,--

(a) in sub- section (1) of section 3, sub- section (1) of section 9, clause (a) of section 10, sub- section (1) of section 11 and sub- section (1) of section 13, for the words State Government", wherever they occur, the words" State Government or, as the case may be, the Central Government" shall be substituted;

(b) in section 10, in clause (a), for the words" three months", the words" one year" shall be substituted;

(c) in the Schedule,--

(i) paragraph 1 shall be omitted;

(ii) in paragraphs 2 and 4,--

(a) after the words" a local authority", the words and figures" or a corporation established by or under a Central, Provincial or State Act, or an authority or a body owned or controlled or aided by Government or a Government company as defined in section 617 of the Companies Act, 1956 (1 of 1956 .) or a society aided by such corporation, authority, body or Government company" shall be inserted;

(b) after the words" or authority", the words" or corporation or body or Government company or society" shall be inserted;

(iii) for paragraph 4A, the following paragraph shall be substituted, namely:--" 4A. An offence punishable under the Prevention of Corruption Act, 1988 .";

(iv) in paragraph 5, for the words and figures" items 2, 3 and 4", the words, figures and letter" items 2, 3, 4 and 4A" shall be substituted.

29. 1944 के अध्यादेश 36 का संशोधन –

1944 के दंड विधि संशोधन अध्यादेश में –

(क) धारा 3 की उपधारा (1), धारा 9 की उपधारा (1), धारा 10 के खंड (क), धारा 11 की उपधारा (1) और धारा 13 की उपधारा (1) में शब्द, “राज्य सरकार” जहां कहीं भी है, के स्थान पर शब्द ‘राज्य सरकार अथवा यथास्थिति केन्द्र सरकार” शब्द प्रतिस्थापित किए जाएँ।

(ख) धारा 10 के खंड (क) में शब्द ‘तीन माह” के स्थान पर शब्द ‘एक वर्ष” प्रतिस्थापित किए जाएं।

(ग) अनुसूची में -- (एक) कंडिका 1 विलुप्त की जाए। (दो) कंडिका 2 एवं 4 में -

(क) शब्दों ‘कोई स्थानीय प्राधिकारी” के पश्चात् शब्दों और अंकों “या किसी केन्द्रीय, प्रांतीय या राज्य अधिनियम के द्वारा या तहत स्थापित कोई निगम, या सरकार द्वारा स्वामित्वाधीन या नियंत्रणाधीन कोई प्राधिकरण या निकाय या कम्पनी अधिनियम, 1956 (1956 का 1) की धारा 617 में यथा परिभाषित कोई शासकीय कंपनी या ऐसे निगम, प्राधिकरण, निकाय या शासकीय कंपनी द्वारा सहायता प्राप्त कोई सोसाइटी" अंत:स्थापित किये जाएंगे;

(ख) शब्दों ‘या प्राधिकरण" के पश्चात् शब्द ‘या निगम या निकाय या शासकीय कंपनी या सोसाइटी" अंत:स्थापित किये जाएंगे;

(तीन) कंडिका 4-क के स्थान पर निम्न कंडिका प्रतिस्थापित की जाए, अर्थात् :-

“4-क. भ्रष्टाचार निवारण अधिनियम, 1988 के अधीन दंडनीय कोई अपराध” (चार) कंडिका 5 में शब्दों और अंकों, मद 2, 3 और 4 के स्थान पर शब्द और अंक "मद 2, 3, 4 और 4-क” प्रतिस्थापित किए जाएँ।
