व्यक्ति जो दत्तक लिये जा सकते हैं (Persons who may be adopted)

10. व्यक्ति जो दत्तक लिये जा सकते हैं -- कोई भी व्यक्ति दत्तक लिये जाने के योग्य न होगा जब तक कि निम्नलिखित शर्ते पूरी न हों अर्थात् :

(i) वह हिन्दू है;

(ii) वह पहले ही से दत्तक नहीं लिया जा चुका है, या ली जा चुकी है;

(ii) उसका विवाह नहीं हुआ है, तब के सिवाय जब कि पक्षकारों को लागू होने वाली कोई ऐसी रूढ़ि या प्रथा हो जो विवाहित व्यक्तियों का, दत्तक लिया जाना अनुज्ञात करती हो;

(iv) उसने पन्द्रह वर्ष की आयु पूरी नहीं की है तब के सिवाय जब कि पक्षकारों को लागू होने वाली कोई ऐसी रूढ़ि या प्रथा हो जो ऐसे व्यक्तियों का, जिन्होंने पन्द्रह वर्ष की आयु पूरी कर ली हो, दत्तक लिया जाना अनुज्ञात करती हो ।

10. Persons who may be adopted - No person shall be capable of being taken in adoption unless the following conditions are fulfilled, namely-

(i) he or she is a Hindu;

(ii) he or she has not already been adopted;

(iii) he or she has not been married, unless there is a custom or usage applicable to the parties which permits persons who are married being taken in adoption;

(iv) he or she has not completed the age of fifteen years, unless there is a custom or usage applicable to the parties which permits persons who have completed the age of fifteen years being taken in adoption.
