सदोष अवरोध और सदोष परिरोध के विषय में
339. सदोष अवरोध -
जो कोई किसी व्यक्ति को स्वेच्छया ऐसे बाधा डालता है कि उस व्यक्ति को उस दिशा में, जिसमें उस व्यक्ति को जाने का अधिकार है, जाने से निवारित कर दे, वह उस व्यक्ति का सदोष अवरोध करता है, यह कहा जाता है।
अपवाद - भूमि के या जल के किसी प्राइवेट मार्ग में बाधा डालना जिसके संबंध में किसी व्यक्ति को सद्भावपूर्वक विश्वास है कि वहां बाधा डालने का उसे विधिपूर्ण अधिकार है, इस धारा के अर्थ के अन्तर्गत अपराध नहीं है।
दृष्टांत -
क एक मार्ग में, जिससे होकर जाने का य का अधिकार है, सद्भावपूर्वक यह विश्वास न रखते हुए कि उसको मार्ग रोकने का अधिकार प्राप्त है, बाधा डालता है। य जाने से तद्द्वारा रोक दिया जाता है। क, य का सदोष अवरोध करता है।
Of wrongful restraint and wrongful confinement
339. Wrongful restraint -
Whoever voluntarily obstructs any person so as to prevent that person from proceeding in any direction in which that person has a right to proceed, is said wrongfully to restrain that person.
Exception - The obstruction of a private way over land or water which a person in good faith believes himself to have a lawful right to obstruct, is not an offence within the meaning of this section.
Illustration -
A obstructs a path along which Z has a right to pass. A not believing in good faith that he has a right to stop the path. Z is thereby prevented from passing. A wrongfully restrains Z.
