317. शिशु के पिता या माता या उसकी देखरेख रखने वाले व्यक्ति द्वारा बारह वर्ष से कम आयु के शिशु का अरक्षित डाल दिया जाना और परित्याग -
जो कोई बारह वर्ष से कम आयु के शिशु का पिता या माता होते हुए, या ऐसे शिशु की देखरेख का भार रखते हुए, ऐसे शिशु का पूर्णत: परित्याग करने के आशय से उस शिशु को किसी स्थान में अरक्षित डाल देगा या छोड़ देगा, वह दोनों में से किसी भाँति के कारावास से, जिसकी अवधि सात वर्ष तक की हो सकेगी, या जुर्माने से, या दोनों से, दण्डित किया जाएगा।
स्पष्टीकरण - यदि शिशु अरक्षित डाल दिए जाने के परिणामस्वरूप मर जाए, तो, यथास्थिति, हत्या या आपराधिक मानव वध के लिए अपराधी का विचारण निवारित करना इस धारा से आशयित नहीं है।

317. Exposure and abandonment of child under twelve years, by parent or person having care of it -
Whoever being the father or mother of a child under the age of twelve years, or having the care of such child, shall expose or leave such child in any place with the intention of wholly abandoning such child, shall be punished with imprisonment of either description for a term which may extend to seven years, or with fine, or with both.
Explanation - This section is not intended to prevent the trial of the offender for murder or culpable homicide, as the case may be, if the child die in consequence of the exposure.
