120 ख. आपराधिक षड़यंत्र का दण्ड -

(1) जो कोई मृत्यु, आजीवन कारावास या दो वर्ष या उससे अधिक अवधि के कठिन कारावास से दण्डनीय अपराध करने के आपराधिक षड़यंत्र में शरीक होगा, यदि ऐसे षड़यंत्र के दण्ड के लिए इस संहिता में कोई अभिव्यक्त उपबंध नहीं है, तो वह उसी प्रकार दण्डित किया जाएगा, मानो उसने ऐसे अपराध का दुष्प्रेरण किया था।

(2) जो कोई पूर्वोक्त रूप से दण्डनीय अपराध को करने के आपराधिक षड़यंत्र से भिन्न किसी आपराधिक षड़यंत्र में शरीक होगा, वह दोनों में से किसी भांति के कारावास से, जिसकी अवधि छह मास से अधिक की नहीं होगी, या जुर्माने से, या दोनों से, दण्डित किया जाएगा।

120 B. Punishment of criminal conspiracy -

(1) Whoever is a party to a criminal conspiracy to commit an offence punishable with death, imprisonment for life or rigorous imprisonment for a term of two years or upwards, shall, where no express provision is made in this Code for the punishment of such a conspiracy, be punished in the same manner as if he had abetted such offence.

(2) Whoever is a party to a criminal conspiracy other than a criminal conspiracy to commit an offence punishable as aforesaid shall be punished with imprisonment of either description for a term not exceeding six months, or with fine or with both.
