93. संदिग्धार्थ दस्तावेज को स्पष्ट करने या उसका संशोधन करने के साक्ष्य का अपवर्जन -- जबकि किसी दस्तावेज में प्रयुक्त भाषा देखते ही संदिग्धार्थ या त्रुटिपूर्ण है, तब उन तथ्यों का साक्ष्य नहीं दिया जा सकेगा, जो उनका अर्थ दर्शित या उसकी त्रुटियों की पूर्ति कर दें।
दृष्टांत
(क) ख को क 1,000 रुपयों या 1,500 रुपयों में एक घोड़ा बेचने का लिखित करार करता है।
यह दर्शित करने के लिए कि कौन-सा मूल्य दिया जाना था, साक्ष्य नहीं दिया जा सकता।
(ख) किसी विलेख में रिक्त स्थान है। उन तथ्यों का साक्ष्य नहीं दिया जा सकता जो यह दर्शित करते हों कि उनकी किस प्रकार पूर्ति अभिप्रेत थी।
93. Exclusion of evidence to explain or amend ambiguous document -- When the language used in a document is, on its face, ambiguous or defective, evidence may not be given of facts which would show its meaning or supply its defects.
Illustrations
(a) A agrees, in writing, to sell a horse to B for “Rs. 1,000 or Rs. 1,500".
Evidence cannot be given to show which price was to be given.
(b) A deed contains blanks. Evidence cannot be given of facts which would show how they were meant to be filled.
