73-क. अंकीय चिह्न के सत्यापन के बारे में सबूत -- यह अभिनिश्चित करने के लिए कि क्या कोई अंकीय चिह्नक उस व्यक्ति का है जिसके द्वारा उसका लगाया जाना तात्पर्यित है, न्यायालय यह निदेश दे सकेगा कि :-

(क) वह व्यक्ति या नियंत्रक या प्रमाणकर्ता प्राधिकारी अंकीय चिह्नक प्रमाण-पत्र पेश करे;

(ख) कोई अन्य व्यक्ति अंकीय चिह्नक प्रमाण-पत्र में सूचीबद्ध लोक कुंजी के लिए आवेदन करे और उस अंकीय चिह्नक को जिसका उस व्यक्ति द्वारा लगाया जाना तात्पर्यित है, सत्यापित करे।

स्पष्टीकरण -- इस धारा के प्रयोजनों के लिए, “नियंत्रक" से सूचना प्रौद्योगिकी अधिनियम, 2000 की धारा 17 की उपधारा (1) के अधीन नियुक्त नियंत्रक अभिप्रेत है।

73-A. Proof as to verification of digital signature - In order to ascertain whether a digital signature is that of the person by whom it purports to have been affixed, the Court may direct :-

a. that person or the Controller or the Certifying Authority to produce the Digital Signature Certificate;

b. any other person to apply the public key listed in the Digital Signature Certificate and verity the digital signature purported to have been affixed by that person.

Explanation -- For the purposes of this section, “Controller" means the Controller appointed under sub-section (1) of Section 17 of the Information Technology Act, 2000.
