व्यावृत्ति और छूट देने की शक्ति (Saving and power to exempt)

14. व्यावृत्ति और छूट देने की शक्ति -

(1) धारा 8, 9 और 9क के सिवाय इस अधिनियम की कोई बात -

(क) केन्द्रीय सरकार द्वारा बनाए गए नियमों या विनियमों के अनुसार संघ के किसी सशस्त्र बल और आर्डिनिंस फैक्टरियों या ऐसे बल के अन्य स्थापनों द्वारा;

(ख) केन्द्रीय सरकार के अधीन या राज्य सरकार के अधीन नियोजित किसी व्यक्ति द्वारा इस अधिनियम के निष्पादन में, किसी विस्फोटक के विनिर्माण, कब्जे, प्रयोग, परिवहन या आयात को लागू नहीं होगी ।

(2) केन्द्रीय सरकार किसी विस्फोटक और किसी व्यक्ति या व्यक्तियों के वर्ग को इस अधिनियम या इसके अधीन बनाए गए नियमों के सब उपबन्धों या उनमें से किसी से पूर्णतः या किन्ही ऐसी शर्तों के अध्यधीन, जिन्हें अधिरोपित करना वह ठीक समझे, शासकीय राजपत्र में अधिसूचना द्वारा छूट दे सकेगी ।

14. Saving and power to exempt. -

(1) Nothing in this Act, except sections 8,9 and 9A shall apply to the manufacture, possession, use, transport or importation of any explosive -

(a) by any of the Armed Forces of the Union, and ordnance factories or other establishments of such Forces in accordance with rules or regulations made by the Central Government;

(b) by any person employed under the Central Government or under a State Government in execution of this Act.

(2) The Central Government may by notification in the Official Gazette exempt, absolutely or subject to any such conditions as it may think fit to impose, any explosive and any person or class of persons from all or any of the provisions of this Act or the rules made thereunder.
