वायुयान या जलयान का करस्थम्‌ (Distress of aircraft or vessel)

11. वायुयान या जलयान का करस्थम्‌ -

जहां किसी वायुयान या जलयान के स्वामी या मास्टर को उस वायुयान या जलयान से या के संबंध में किए गए किसी अपराध के लिए जुर्माना संदत्त करने के लिए इस अधिनियम के अधीन न्यायनिर्णीत किया जाता है वहां न्यायालय, जुर्माने का संदाय करने को विवश करने के प्रयोजन के लिए अपनी किसी अन्य शक्ति के अतिरिक्त यह निदेश दे सकेगा कि,-

(क) उस वायुयान और उसके फर्नीचर या फर्नीचर के उतने भाग को, या

(ख) जलयान और उसके टैकल, पोत सज्जा और फर्नीचर या उसके टैकल, पोत सज्जा और फर्नीचर के उतने भाग को, जितना जुर्माने के संदाय के लिए आवश्यक हो, करस्थम्‌ और विक्रय द्वारा उदगृहीत किया जाए ।

11. Distress of aircraft or vessel. -

Where the owner or Master of any aircraft or vessel is adjudged under this Act to pay a fine for any offence committed with, or in relation to, that aircraft or vessel, the. Court may, in addition to any power it may have for the purpose of compelling payment of the fine, direct it to be levied by distress and sale of,-

(a) the aircraft and its furniture or so much of the furniture, or

(b) the vessel and the tackle, apparel and furniture of such vessel or so much of the tackle, apparel and furniture thereof, as is necessary for the payment of the fine.
