7. निरीक्षण, तलाशी, अभिग्रहण, निरोध और हटाने की शक्तियां प्रदत्त करने के लिए नियम बनाने की शक्ति -

(1) केन्द्रीय सरकार इस अधिनियम से संगत नियम किसी अधिकारी को या तो नाम से उसके पद के आधार से यह प्राधिकृत करने के लिए बना सकेगी कि वह -

(क) किसी ऐसे स्थान, वायुयान, गाड़ी या जलयान में जिसमें इस अधिनियम के अधीन अनुदत्त अनुज्ञप्ति के अधीन किसी विस्फोटक का विनिर्माण, उस पर कब्जा, उसका प्रयोग, विक्रय, परिवहन, आयात या निर्यात किया जा रहा है या जिसमें उसके पास यह विश्वास करने का कारण है कि इस अधिनियम या इस अधिनियम के अधीन बनाए गए नियमों के उल्लंघन में किसी विस्फोटक का विनिर्माण, उस पर कब्जा, उसका प्रयोग, विक्रय, परिवहन, आयात या निर्यात किया गया है या किया जा रहा है, प्रवेश करे, निरीक्षण करे और परीक्षा करे;

(ख) वहां विस्फोटकों के लिए तलाशी ले;

(ग) वहां पाए गए किसी विस्फोटक के, उसका मूल्य संदाय करके, नमूने ले; और

(घ) उसमें से किसी विस्फोटक या उसके संघटक को अभिगृहीत करे, निरुद्ध करे और हटाए और यदि आवश्यक हो तो ऐसे विस्फोटक या उसके संघटक को नष्ट भी करे।

(2) दंड प्रक्रिया संहिता, 1973 (1974 का 2) के वे उपबंध जो उस संहिता के अधीन तलाशियों से संबद्ध हैं, इस धारा के अधीन नियमों द्वारा प्राधिकृत अधिकारियों द्वारा तलाशियों को लागू होंगे जहां तक वे लागू हो सकते हैं।

7. Power to make rules conferring powers of inspection, search, seizure, detention and removal. -

(1) The Central Government may make rules consistent with this Act authorising any officer, either by name or in virtue of his office.-

(a) to enter, inspect and examine any place, aircraft, carriage or vessel] in which an explosive is being manufactured, possessed, used, sold, transported, imported or exported under a license granted under this Act, or in which he has reason to believe that an explosive has been or is being manufactured, possessed, used, sold, transported, imported or exported in contravention of this Act or of the rules made under this Act;

(b) to search for explosives therein;

(c) to take samples of any explosive found therein on payment of the value thereof; and

[(d) to seize, detain and remove any explosive or ingredient thereof found therein and, if necessary, also destroy such explosive or ingredient.

(2) The provisions of the Code of Criminal Procedure, 1973 (2 of 1974) relating to searches under that Code shall, so far as the same are applicable, apply to searches by officers authorised by rules under this section.
