अनुज्ञप्तियों के लिए इंकार करना (Refusal of licences) - EXPLOSIVES ACT, 1884

6 ग. अनुज्ञप्तियों के लिए इंकार करना -

(1) धारा 6 ख में किसी बात के होते हुए भी, अनुज्ञापन प्राधिकारी निम्नलिखि दशाओं में अनुज्ञप्ति अनुदत्त करने से इंकार कर सकेगा :--

(क) जहां ऐसी अनुज्ञप्ति किसी प्रतिषिद्ध विस्फोटक के संबंध में अपेक्षित है; या

(ख) जहां ऐसी अनुज्ञप्ति के लिए किसी ऐसे व्यक्ति ने अपेक्षा की है जिसके बारे में अनुज्ञापन प्राधिकारी के पास यह विश्वास करने का कारण है कि वह -

(i) किसी ऐसे विस्फोटक का विनिर्माण करने, उसे कब्जे में रखने, उसका विक्रय, परिवहन, आयात या निर्यात करने से इस अधिनियम या तत्समय प्रवृत्त किसी अन्य विधि द्वारा प्रतिषिद्ध है; या

(ii) विकृत चित्त है; या

(iii) इस अधिनियम के अधीन अनुज्ञप्ति के लिए किसी अन्य कारणवश अनुपयुकत है; या

(ग) जहां अनुज्ञापन प्राधिकारी लोक-शांति की सुरक्षा या लोक सुरक्षा के लिए ऐसी अनुज्ञप्ति अनुदत्त करने से इंकार करना आवश्यक समझे ।

(2) जहां अनुज्ञापन प्राधिकारी किसी ऐसे व्यक्ति को कोई अनुज्ञप्ति अनुदत्त करने से इंकार कर देता है वहां वह ऐसे इंकार करने के कारण लेखबद्ध करेगा और उस व्यक्ति द्वारा मांग की जाने पर उसका एक संक्षिप्त कथन उसको देगा जब तक कि किसी मामले में अनुज्ञापन प्राधिकारी की यह राय न हो कि ऐसे कथन का दिया जाना लोक हित में नहीं होगा ।

6 C. Refusal of licences.-

(1) Notwithstanding anything contained in section 6B, the licensing authority shall refuse to grant a licence -

(a) where such licence is required in respect of any prohibited explosive; or

(b) where such licence is required by a person whom the licensing authority has reason to believe -

(i) to be prohibited by this Act or by any other law for the time being in force to manufacture, possess, sell, transport import or export any explosive, or

(ii) to be of unsound mind, or

(iii) to be for any reason unfit for a licence under this Act; or

(c) where the licensing authority deems it necessary for the security of the public peace or for public safety to refuse to grant such licence.

(2)Where the licensing authority refuses to grant a licence to any person it shall record in writing the reasons for such refusal and furnish to that person on demand a brief statement of the same unless in any case the licensing authority is of opinion that it will not be in the public interest to furnish such statement.
