परिभाषाएं (Definitions) - EXPLOSIVES ACT, 1884

4. परिभाषाएं -

इस अधिनियम में जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,-

(क) “वायुयान” से कोई ऐसी मशीन अभिप्रेत है जो वातावरण से पृथ्वी की सतह पर वायु की प्रक्रिया से भिन्‍न वायु की प्रतिक्रिया द्वारा अवलम्ब प्राप्त कर सकती है, और इसके अन्तर्गत बेलून, चाहे स्थिर हों या अस्थिर, वायु पोत, पतंग, ग्लाइडर और उड्डयन मशीनें हैं;

(ख) “गाड़ी” के अन्तर्गत कोई गाड़ी, वैगन, छकड़ा, ट्रक, यान या भूमि पर माल या यात्रियों को ले जाने का कोई अन्य साधन है चाहे वह किसी प्रकार से चलाया जाए;

(ग) किसी ऐसे क्षेत्र के संबंध में, जिसके लिए पुलिस आयुक्त नियुक्त कर दिया गया है, “जिला मजिस्ट्रेट” से उस क्षेत्र का पुलिस आयुक्त अभिप्रेत है और इसके अन्तर्गत निम्नलिखित भी हैं :--

(क) ऐसे सम्पूर्ण क्षेत्र या उसके किसी भाग पर अधिकारिता का प्रयोग करने वाला ऐसा कोई पुलिस उपायुक्त जो ऐसे क्षेत्र या उसके किसी भाग के संबंध में इस निमित्त राज्य सरकार द्वारा विनिर्दिष्ट किया जाए, और

(ख) कोई अपर जिला मजिस्ट्रेट;

(घ) “विस्फोटक” से अभिप्रेत है बारूद, नाइट्रोग्लिसरीन, नाइट्रोग्लिकोल, गनकाटन, डाइनाट्रो-टोल्यून, ट्राई नाइट्रो- टोल्यून, पिकरिक एसिड, डाई-नाइट्रो-फिनॉल, ट्राई-नाइट्रो रिसार्सिनाल (स्टाइफिनिक एसिड), साइकलो ट्राइमेथिलीन ट्राइ- नाइट्रामाइन, पेन्टा एरिश्रिटॉल-ट्रेटानाइट्रैट, टेट्रिल, नाइट्रोलग्वानिडीन, लेड एजाइड, लेड स्टाइफारेइनेट, पारे या अन्य धातु; या फल्मिनेट, डाइएजो-डाइनाइट्रो-फिनाल, रंगी आतिश या अन्य पदार्थ चाहे वह एक रसायन सम्मिश्रण या पदार्थों का मिश्रण हो, चाहे वह ठोस या तरल या गैसीय हो, जिसका प्रयोग या विनिर्माण विस्फोट द्वारा व्यावहारिक प्रभाव उत्पन्न करना या आतिशबाजी करना हो; और कुहरा-संकेत, आतिशबाजी, पतीले, राकेट, आघात टोपियां, विस्फोटक प्रेरक, कारतूस, सभी प्रकार के गोलाबारूद और इस खण्ड में यथा परिभाषित विस्फोटक का प्रत्येक अनुकूलन या निर्मित इसके अन्तर्गत है;

(ङ) “निर्यात” से भूमि, समुद्र या वायु मार्ग के बाहर किसी स्थान पर भारत से ले जाना अभिप्रेत है;

(च) “आयात” से भूमि, समुद्र या वायु मार्ग से भारत के बाहर किसी स्थान से भारत में लाना अभिप्रेत है;

(छ) “मास्टर” से,-

(क) किसी जलयान या वायुयान के संबंध में पाइलट, बन्दरगाह मास्टर, सहायक बंदरगाह मास्टर या बर्थिंग मास्टर से भिन्‍न ऐसा कोई व्यक्ति अभिप्रेत है जो तत्समय, यथास्थिति, ऐसे जलयान या वायुयान का भारसाधक या उसका नियंत्रक है; और

(ख) किसी पोत की किसी नौका के संबंध में उस पोत का मास्टर अभिप्रेत है;

(ज) “विनिर्माण” के अन्तर्गत किसी विस्फोटक के संबंध में निम्नलिखित की प्रक्रिया भी है :-

(1) विस्फोटक को उसके संघटक भागों में विभाजित करने या अन्यथा रूप से तोड़ने या विघटित करने अथवा किसी खराब विस्फोटक को प्रयोग के योग्य बनाना; और

(2) विस्फोटक को फिर से बनाना, उसमें परिवर्तन करना या उसकी मरम्मत करना;

(झ) “विहित” से इस अधिनियम के अधीन बनाए गए नियमों द्वारा विहित अभिप्रेत है;

(ज) “जलयान” के अन्तर्गत कोई पोत, नौका, पाल-जलयान या किसी अन्य प्रकार का जलयान जो नौपरिवहन के लिए प्रयुक्त किया जाता है चाहे वह पतवारों से या अन्यथा चालित हो और मनुष्यों को या माल को मुख्यत: जल मार्ग द्वारा लाने या ले जाने के लिए बनाई गई कोई अन्य चीज और कसेन भी है।

4. Definitions. —

In this Act, unless the context otherwise requires,—

(a) “aircraft” means any machine which can derive support in the atmosphere from the reactions of the air, other than the reactions of the air against the earth’s surface, and includes balloons, whether fixed or free, airships, kites, gliders and flying machines;

(b) “carriage” includes any carriage, wagon, cart, truck, vehicle or other means of conveying goods or passengers by land, in whatever manner the same may be propelled,

(c) “District Magistrate”, in relation to any area for which a Commissioner of Police has been appointed, means the Commissioner of Police thereof and includes—

(a) any such Deputy Commissioner of Police, exercising jurisdiction over the whole or any part of such area, as may be specified by the State Government in this behalf in relation to such area or part: and

(b) an Additional District Magistrate;

(d) “explosive” means gunpowder, nitoglycerine, nitroglycol, gun-cotton, di-nitro-toluene, tri-nitro-toluene, picric acid, di-nitro-phenol, tri-nitro-resorcinol (styphnic acid), cyclo-trime- thylene-trinitramine, penta-erythritol-tetranitrate, tetryl, nitro-guanidine, leadazide, lead styphynate, fulminate of mercury or any other metal, diazo-di-nitro-phenol, coloured fires or any other substance whether a single chemical compound or a mixture of substances, whether solid or liquid or gaseous used or manufactured with a view to produce a practical effect by explosion or pyrotechnic effect; and includes fog-signals, fireworks, fuses, rockets, percussion-caps, detonators, cartidgcs, ammunition of all descriptions and every adaptation or preparation of an explosive as defined in this clause;

(e) “export” means taking out of India to a place outside India by land, sea or air;

(f) “import” means to bring into India from a place outside India by land, sea or air;

(g) “master”,—

(a) in relation to any vessel or aircraft means any person, other than a pilot, harbour master, assistant harbour master or berthing master, having for the time being the charge or control of such vessel or aircraft, as the ease may be; and

(b) in relation to any boat belonging to a ship, means the master of that ship;

(h) “manufacture” in relation to an explosive includes the process of—

(1) dividing the explosive into its component parts or otherwise breaking up or unmaking the explosive, or making fit for use any damaged explosive; and

(2) re-making, altering or repairing the explosive;

(i) “prescribed- means prescribed by rules made under this Act;

(j) “vessel” includes any ship, boat, sailing vessel, or other description of vessel used in navigation whether propelled by oars or otherwise and anything made for the conveyance, mainly by water, of human beings or of goods and a caisson.
