29. विनिर्दिष्ट पालन के वाद में विखंडन के लिये अनुकल्पित प्रार्थना  -

किसी लिखित संविदा के विनिर्दिष्ट पालन का वाद संस्थित करने वाला वादी अनुकल्पत: यह प्रार्थना कर सकेगा कि यदि संविदा विनिर्दिष्टत: प्रवर्तित नहीं की जा सकती, तो वह विखंडित कर दी जाए और रद्द किए जाने के लिए न्यायालय को परिदत्त कर दी जाए और न्यायालय यदि संविदा को विनिर्दिष्टत: प्रवर्तित कराने से इंकार कर दे तो वह तद्नुसार उसके विखंडित और न्यायालय को परिदत्त किए जाने को निर्दिष्ट कर सकेगा ।

29. Alternative prayer for rescission in suit for specific performance.-

A plaintiff instituting a suit for the specific performance of a contract in writing may pray in the alternative that, if the contract cannot be specifically enforced, it may be rescinded and delivered up to be cancelled; and the court, if it refuses to enforce the contract specifically, may direct it to be rescinded and delivered up accordingly.
