संविदाएँ जिनका विनिर्दिष्टतः पालन नहीं कराया जा सकता
14. ऐसी संविदाएँ, जो विनिर्दिष्टतया प्रवर्तनीय नहीं हैं -
14. ऐसी संविदाएं, जो विनिर्दिष्टतया प्रवर्तनीय नहीं हैं.-- निम्नलिखित संविदाओं को विनिर्दिष्टतया प्रवर्तित नहीं कराया जा सकता, अर्थात् :-
(क) जहां संविदा के किसी पक्षकार ने संविदा का प्रतिस्थापित पालन धारा 20 के उपबंधों के अनुसार अभिप्राप्त कर लिया है।
(ख) कोई ऐसी संविदा, जिसके पालन में ऐसे किसी निरंतर कर्तव्य का पालन अंतर्वलित है, जिसका न्यायालय पर्यवेक्षण नहीं कर सकता;
(ग) कोई ऐसी संविदा, जो पक्षकारों की व्यक्तिगत अर्हताओं पर इतनी निर्भर है कि न्यायालय उसके तात्विक निबंधनों का विनिर्दिष्ट पालन नहीं करा सकता;
(घ) कोई ऐसी संविदा, जो अवधारणीय प्रकृति की है।

14. Contracts not specifically enforceable -
14. Contracts not specifically enforceable.--The following contracts cannot be specifically enforced, namely:-
(a) where a party to the contract has obtained substituted performance of contract in accordance with the provisions of section 20;
(b) a contract, the performance of which involves the performance of a continuous duty which the court cannot supervise;
(c) a contract which is so dependent on the personal qualifications of the parties that the court cannot enforce specific performance of its material terms; and
(d) a contract which is in its nature determinable.
