20. "न्यायालय" -

"न्यायालय" शब्द उस न्यायाधीश का, जिसे अकेले ही को न्यायिकतः कार्य करने के लिए विधि द्वारा सशक्त किया गया हो, या उस न्यायाधीश निकाय का, जिसे एक निकाय के रूप में न्यायिकतः कार्य करने के लिए विधि द्वारा सशक्त किया गया हो, जबकि ऐसा न्यायाधीश या न्यायाधीश निकाय न्यायिकतः कार्य कर रहा है, ध्योत्तक है।

दृष्टान्त

मद्रास संहिता के सन् 1816 के विनियम 7 के अधीन कार्य करने वाली पंचायत जिसे वादों का विचारण करने और अवधारण करने की शक्ति प्राप्त है, न्यायालय है।

20. "Court of Justice" -

The words “Court of Justice" denote a Judge who is empowered by law to act judicially alone, or a body of Judges which is empowered by law to act judicially as a body, when such Judge or body of Judges is acting judicially.

Illustration

A panchayat acting under Regulation VII, 1816, of the Madras Code, having power to try and determine suits is a Court of Justice.
