सम्मत न होने वाले पक्षकार विशेषित या सीमित प्रतिग्रहण द्वारा उन्मोचित हो जाते हैं (Parties not consenting discharged by qualified or limited acceptance)

86 सम्मत न होने वाले पक्षकार विशेषित या सीमित प्रतिग्रहण द्वारा उन्मोचित हो जाते हैं -- यदि विनिमय-पत्र का धारक ऐसे प्रतिग्रहण से उपमत हो जाता है जो विशेषित है, या विनिमय-पत्र में वर्णित राशि के एक भाग तक सीमित है या जो संदाय के लिए कोई भिन्न स्थान या समय प्रतिस्थापित करता है या जो उस दशा में जहाँ कि ऊपरवाल भागीदार नहीं है, उन सब के द्वारा हस्ताक्षरित नहीं है तो जब तक कि वे सब पूर्विक पक्षकार, जिनकी ऐसे प्रतिग्रहण के लिए सम्मति अभिप्राप्त नहीं की गई है, धारक द्वारा सूचना दी जाने पर ऐसे प्रतिग्रहण के लिए अपनी अनुमति नहीं दे देते, वे जहाँ तक कि धारक और उनसे व्युत्पन्न अधिकार के अधीन दावा करने वालों का सम्बन्ध है, उन्मोचित हो जाते हैं ।
स्पष्टीकरण -- प्रतिग्रहण वहाँ विशेषित होता है
(क) जहाँ कि वह सशर्त है अर्थात् यह घोषित करता है कि संदाय उसमें कथित घटना के होने पर निर्भर करेगा;
(ख) जहाँ कि वह संदत की जाने के लिए आदिष्ट राशि के केवल भाग के संदाय का वचन देता है;
(ग) जहाँ कि आदेश में संदाय के लिए कोई स्थान विनिर्दिष्ट न होते हुए वह विनिर्दिष्ट स्थान में, न कि अन्यथा या अन्यत्र, संदाय का वचन देता है अथवा जहाँ कि आदेश में संदाय का स्थान विनिर्दिष्ट होते हुए वह किसी दूसरे स्थान में, न कि अन्यथा या अन्यत्र, संदाय का वचन देता है |
(घ) जहाँ कि वह उस समय से भिन्न समय पर संदाय का वचन देता है जिस समय पर आदेश के अधीन वह वैध रूप से शोध्य होगा ।
86. Parties not consenting discharged by qualified or limited acceptance -If the holder of a bill of exchange acquiesces in a qualified acceptance, or one limited to part of the sum mentioned in the bill, or which substitutes a different place or time for payment, or which, where the drawees are not partners, is not signed by all the drawees, all previous parties whose consent is not obtained to such acceptance are discharged as against the holder and those claiming under him, unless on notice given by the holder they assent to such acceptance.
Explanation — An acceptance is qualified --
(a) where it is conditional, declaring the payment to be dependent on the happening of an event therein stated;
(b) where it undertakes the payment of part only of the sum ordered to be paid;
(c) where no place of payment being specified on the order, it undertakes the payment at a specified place, and not otherwise or elsewhere; or where, a place of payment being specified in the order, it undertakes the payment at some other place and not otherwise or elsewhere;
(d) where it undertakes the payment at a time other than that at which under the order it would be legally due.
