44. धन के रूप में प्रतिफल को भागत: अभाव या निष्फल हो जाना -- जबकि वह प्रतिफल, जिसके लिए किसी व्यक्ति ने वचन-पत्र, विनिमय-पत्र या चैक को हस्ताक्षरित किया है, धन के रूप में या और प्रारंभ में भागतः विद्यमान न था या तत्पश्चात्, भागतः निष्फल हो गया है, तब वह राशि, जिसे ऐसे हस्ताक्षरकर्ता से अव्यवहित सम्बन्ध में स्थित धारक उससे पाने का हकदार होगा अनुपात: कम हो जाती है ।
स्पष्टीकरण -- विनिमय-पत्र को लेखीवाल प्रतिगृहीता से अन्यत्रहित सम्बन्ध में स्थित होता है। वचन-पत्र, विनिमय-पत्र या चैक का रचयिता पाने वाले से और पृष्ठांकक अपने पृष्ठांकिती से अव्यवहित सम्बन्ध में स्थित होता है । अन्य हस्ताक्षरकर्ता धारक से अव्यवहित सम्बन्ध में करार द्वारा स्थित हो सकेंगे ।
दृष्टान्त
क अपने आदेशानुसार देय 500 रुपये का विनिमय-पत्र ख पर लिखता है । ख विनिमय-पत्र को प्रतिगृहीत कर लेता है, किन्तु तत्पश्चात् संदाय न करके उसे अनादृत कर देता है । क विनिमय -पत्र के आधार पर ख़ पर वाद लाता है । ख साबित कर देता है कि 400 रुपये के लिए तो वह मूल्यार्थ प्रनिगृहीत किया गया था और अवशिष्ट के लिए वादी के सौकर्य के लिए प्रतिग्रहीत किया गया था । क केवल 40 रुपये वसूल कर सकता है ।
44. Partial absence or failure of money-consideration — When the consideration for which a person signed a promissory note, bill of exchange or cheque consisted of money, and was originally absent in part or has subsequently failed in part, the sum which a holder standing in immediate relation with such signer is entitled to receive from him is proportionally reduced.
Explanation — The drawer of a bill of exchange stands in immediate relation with the acceptor. The maker of a promissory note, bill of exchange or cheque stands in immediate relation with the payee, and the indorser with his indorsee. Other signers may by agreement stand in immediate relation with a holder.
Illustration
A draws a bill on B for Rs. 500 payable to the order of A. B accepts the bill. but subsequently dishonours it by non-payment. A sues B on the bill. B proves that it was accepted for value as to Rs. 100, and as an accommodation to the plaintiff as to the residue. A can only recover Rs. 400.
