प्राधिकार के बिना नियुक्त उपाभिकर्ता के लिए अभिकर्ता का उत्तरदायित्व (Agent's responsibility for sub-agent appointed without authority)

193. प्राधिकार के बिना नियुक्त उपाभिकर्ता के लिए अभिकर्ता का उत्तरदायित्व -- जहाँ कि किसी अभिकर्ता के उपाभिकर्ता नियुक्त करने के प्राधिकार के बिना किसी व्यक्ति को उपाभिकर्ता की हैसियत में कार्य करने के लिए नियुक्त किया हो वहाँ अभिकर्ता की उस व्यक्ति के प्रति हैसियत वैसी है जैसी अभिकर्ता के प्रति मालिक की होती है और वह उसके कार्यों के लिए मालिक और पर-व्यक्तियों दोनों के प्रति उत्तरदायी है; ऐसा नियोजित व्यक्ति मालिक का प्रतिनिधित्व नहीं करता और न उसके कार्यों के लिए मालिक उत्तरदायी है और न वह मालिक के प्रति उत्तरदायी है।

193. Agent's responsibility for sub-agent appointed without authority - Where an agent, without having authority to do so, has appointed a person to act as a sub-agent, the agent stands towards such person in the relation of a principal to an agent, and is responsible for his acts both to the principal and to third persons; the principal is not represented by or responsible for the acts of the person so employed, nor is that person responsible to the principal
