176. पणयमदार का अधिकार जहाँ कि पणयमदार व्यतिक्रम करता है -- यदि पणयमकार उस ऋण के संदाय में या अनुबद्ध समय पर उस वचन का पालन करने में, जिसके लिए माल गिरवी रखा गया था, व्यतिक्रमं करता है तो पणयमदार उस ऋण या वचन पर पणयमकार के विरुद्ध वाद ला सकेगा और गिरवी माल का साम्पार्श्विक प्रतिभूति के रूप में प्रतिधारण कर सकेगा, या गिरवी चीज को बेचने की युक्तियुक्त सूचना पणयमकार को देकर उस चीज को बेच सकेगा। यदि ऐसे विक्रय के आगम उस रकम से कम हों, जो ऋण या वचन के बारे में शोध्य हैं, तो पणयमकार बाकी के संदाय के लिए तब भी दायी रहता है। यदि विक्रय के आगम उस रकम से अधिक हों जो ऐसे शोध्य हैं तो पणयमदार वह अधिशेष पणयमकार को देगा।
176. Pawnce's right where pawnor makes default - If the pawnor makes default in payment of the debt, or performance; at the stipulated time or the promise, in respect of which the goods were pledged, the pawnee may bring a suit against the pawnor upon the debt or promise, and retain the goods pledged as a collateral security; or he may sell the thing pledged, on giving the pawnor reasonable notice of the sale. If the proceeds of such sale are less than the amount due in respect of the debt or promise, the pawnor is still liable to pay the balance. If the proceeds of the sale are greater than the amount so due, the pawnee shall pay over the surplus to the pawnor.
