154. उपनिहित माल का अप्राधिकृत उपयोग करने वाला उपनिहिती का दायित्व -- यदि उपनिहिती उपनिहित माल का कोई ऐसा उपयोग करे जो उपनिधान की शर्तों के अनुसार न हो तो वह उसके ऐसे उपयोग से या ऐसे उपयोग के दौरान माल को हुए नुकसान के लिए उपनिधाता को प्रतिकर देने का दायी है।
दृष्टान्त
(क) 'ख' को एक घोड़ा केवल उसकी अपनी सवारी के लिए 'क' उधार देता है। ‘ख’ अपने कुटुम्ब के एक सदस्य 'ग' को उस घोड़े पर सवारी करने देता है। 'ग' सावधानी से सवारी करता है, किन्तु अकस्मात् घोड़ा गिर पड़ता है और क्षत हो जाता है। ‘खघोड़े को हुई क्षति के लिए 'क' को प्रतिकर देने का दायी है।
(ख) 'क' कलकत्ते में ख' से एक घोड़ा यह कहकर भाड़े पर लेता है कि वह वाराणसी जाएगा। ‘क’ सम्यक् सावधानी से सवारी करता है किन्तु वाराणसी न जाकर कटक जाता है। अकस्मात् घोड़ा गिर पड़ता है और क्षत हो जाता है। ‘क’ घोड़े को हुई क्षति के लिए 'ख' को प्रतिकर देने का दायी है।
154. Liability of bailee making unauthorised use of goods bailed - If the bailee makes any use of the goods bailed which is not according to the conditions of the bailment, he is liable to make compensation to the bailor for any damage arising to the goods from or during such use of them.
Illustrations
(a) A lends a horse to B for his own riding only. B allows C, member of his family, to ride the horse. C rides with care, but the horse accidentally falls and is injured. B is liable to make compensation to A for the injury done to the horse.
(b) A hires a horse in Calcutta from B expressly to march to Banaras. A rides with due care, but marches to Cuttack instead. The horse accidentally falls and is injured. A is liable to make compensation to B for the injury to the horse.
