126. “प्रत्याभूति की संविदा”, “प्रतिभू”, “मूलऋणी” और “लेनदार' -- “प्रत्याभूति की संविदा' किसी पर-व्यक्ति द्वारा व्यतिक्रम की दशा में उसके वचन का पालन या उसके दायित्व का निर्वहन करने की संविदा है। वह व्यक्ति जो प्रत्याभूति देता है, “प्रतिभू' कहलाता है, वह व्यक्ति, जिसके व्यतिक्रम के बारे में प्रत्याभूति दी जाती है, मूलऋणी कहलाता है, और वह व्यक्ति जिसको प्रत्याभूति दी जाती है, 'लेनदार' कहलाता है। प्रत्याभूति या तो मौखिक या लिखित हो सकेगी।
126. 'Contract of guarantee', 'surety', 'principal debtor' and 'creditor' - A contract of guarantee' is a contract to perform the promise, or discharge the liability, of a third person in case of his default. The person who gives the guarantee is called the 'surety'; the person in respect of whose default the guarantee is given is called the 'principal debtor', and the person to whom the guarantee is given is called the creditor'. A guarantee may be either oral or written.
