Treaty on transfer of sentenced persons between India and Nigeria

The Cabinet today at the meeting chaired by the Prime Minister, Shri Narendra Modi gave its approval for signing a treaty on transfer of sentenced persons between India and Nigeria.

 

Signing of the treaty shall facilitate Indian prisoners imprisoned in Nigeria or vice-versa to be near their families, for serving the remaining part of their sentence and shall facilitate their social rehabilitation.

 

The Government of India has so far signed Agreements with the Governments of the United Kingdom, Mauritius, Bulgaria, Brazil, Cambodia, Egypt, France, Bangladesh, South Korea, Saudi Arabia, Iran, Kuwait, Sri Lanka, the UAE, Maldives, Thailand, Turkey, Italy, Bosnia & Herzegovina, Israel, Russia and Vietnam. Negotiations have also been concluded with the Governments of Canada, Hong Kong, Australia and Spain.

 

Background:

 

Prior to 2004, there was no domestic legislation under which foreign prisoners could be transferred to the country of their origin, to serve the remaining part of their sentence, nor was there a provision for the transfer of prisoners of Indian origin convicted by a foreign court to serve their sentence in India.

 

Hence the Repatriation of Prisoners Act, 2003 (hereinafter referred as Act) was enacted for serving this purpose. For achieving the objectives of the Act, a treaty/agreement is required to be signed with countries having mutual interest with India and later to be notified in the Official Gazette.

 

 

भारत और नाइजीरिया के बीच सजा काट रहे व्यक्तियों के स्थानांतरण पर संधि

 

प्रधानमंत्री श्री नरेंद्र मोदी की अध्यक्षता में आयोजित हुई मंत्रिमंडल की बैठक में भारत और नाइजीरिया के बीच सजा काट रहे व्यक्तियों के स्थानांतरण संबंधी संधि पर हस्ताक्षर किए जाने को मंजूरी दे दी गई।

 

इस संधि पर हस्ताक्षर करने के बाद नाइजीरिया की जेलों में बंद भारतीय कैदी और भारत में बंद नाइजीरियाई कैदी बाकी की सजा अपने देश की जेलों में काट सकेंगे। इससे वह अपने परिवार के पास रह सकेंगे। इससे उनको सामाजिक पुनर्वास की सुविधा होगी।

 

भारत सरकार युनाइटेड किंगडम, मॉरिशियस, बुल्गेरिया, ब्राजील, कंबोडिया, मिस्र, फ्रांस, बांग्लादेश, दक्षिण कोरिया, साउदी अरब, ईरान, कुवैत, श्रीलंका, यूएई, मालदीव, थाइलैंड, टर्की, इटली, बोसनिया और हर्जेगोविना, इजराइल, रूस और वियतनाम की सरकार के साथ समझौते पर हस्ताक्षर कर चुकी है। इसके अलावा कनाडा, होंगकोंग, ऑस्ट्रेलिया और स्पेन की सरकारों के साथ समझौता वार्ताएं संपन्न कर चुकी हैं।
