मंत्रिमंडल ने पेटेंट प्राप्त करने में तेजी लाने और उसे कारगर बनाने वाले कार्यक्रम को मंजूरी दी

प्रधानमंत्री श्री नरेन्द्र मोदी की अध्यक्षता में मंत्रिमंडल ने पेटेंट, डिजाइन और ट्रेड मार्क महानियंत्रक (सीजीपीडीटीएम) के अधीन भारतीय पेटेंट कार्यालय द्वारा विभिन्न देशों या क्षेत्रों के पेटेंट कार्यालयों के साथ पेटेंट प्राप्त करने में तेजी लाने और उसे कारगर बनाने वाले (पेटेंट प्रॉसेक्यूशन हाईवे-पीपीएच) कार्यक्रम को अपनाए जाने के प्रस्ताव को मंजूरी दे दी है।

उपरोक्त कार्यक्रम प्रायोगिक आधार पर केवल तीन वर्षों के लिए सबसे पहले जापान पेटेंट ऑफिस (जेपीओ) और भारतीय पेटेंट कार्यालय के बीच शुरू होगा। इस प्रायोगिक कार्यक्रम के तहत भारतीय पेटेंट कार्यालय विद्युत, इलेक्ट्रॉनिक्स, कम्प्यूटर विज्ञान, सूचना प्रौद्योगिकी, भौतिकी, सिविल, यांत्रिक, वस्त्र, मोटरवाहन और धातु विज्ञान जैसे तकनीकी क्षेत्रों में पेटेंट आवेदन प्राप्त करेगा, जबकि जेपीओ प्रौद्योगिकी के सभी क्षेत्रों में आवेदन प्राप्त करेगा।

पीपीएच कार्यक्रम से भारतीय पेटेंट कार्यालय को निम्नलिखित लाभ होंगे-

i.     पेटेंट आवेदनों के निपटारे में लगने वाले समय में कमी।

ii.     लंबित पेटेंट आवेदनों में कमी।

iii.    पेटेंट आवेदनों की जांच-पड़ताल की प्रक्रिया में सुधार।

iv.    भारत के स्टार्टअप और एमएसएमई सहित भारतीय निवेशकों को जापान में अपने पेटेंट आवेदनों की जांच-पड़ताल में तेजी लाने का अवसर।

      वाणिज्य एवं उद्योग मंत्री के निर्णय अनुसार भविष्य में कार्यक्रम का दायरा बढ़ाया जा सकता है। कार्यक्रम के क्रियान्वयन के लिए पेटेंट कार्यालय स्वयं अपने दिशा-निर्देशों की रूपरेखा तैयार करेंगे।

The Union Cabinet chaired by the Prime Minister Shri Narendra Modi has approved the proposal for adoption of Patent Prosecution Highway (PPH) programme by the Indian Patent Office (IPO) under the Controller General of Patents, Designs & Trade Marks, India (CGPDTM) with patent offices of various other interest countries or regions.

          The said programme will initially commence between Japan Patent Office (JPO) and Indian Patent Office on a pilot basis for a period of three years only.  Under this Pilot programme, Indian Patent Office may receive patent applications n certain specified technical fields only, namely, Electrical, Electronics, Computer Science, Information Technology, Physics, Civil, Mechanical, Textiles, Automobiles and Metallurgy while JPO may receive applications in all fields of technology.

PPH programme would lead to the following benefits for the Indian IP office:

1. Reduction in time to dispose patent applications.

2. Reduction in pendency of patent applications.

3. Improvement in quality of search and examination of patent applications.

4. An opportunity for Indian inventors including MSMEs and Startups of India to get accelerated examination of their patent applications in Japan.

The ambit of the programme may be extended in future, as decided by the Commerce & Industry Minister.  The patent offices will frame their own guidelines for implementation of the programme.
