THE WEST BENGAL PUBLIC GAMBLING (PENALTIES ENHANCEMENT) ACT, 1950

West Bengal Act XXXII of 1950

    An Act to enhance the penalties provided by law for the punishment of certain off ences relating to wagering or betting upon a horse-race.

    WHEREAS it is expedient to enhance the penalties provided by law for the punishment of certain offences relating to agering or betting upon a horse-race ;

    It is hereby enacted as follows:-

1. Short title:- This Act may be called the West Bengal Public Gambling (Penalties Enhancement) Act, 1950.

2. Punishment for offences o illegal wagering or betting upon a horse-race:- (1) Whoever commits an offence punishable under section 10 of the Howrah Offences Act, 1857, or under section 44 of the Calcutta Police Act, 1866, or under section 3 of the Bengal Public Gambling Act, 1867, relating to wagering or betting upon a horse-race may, in lieu of any punishment to whic he is liable under the said sections, be punished with imprisonment for a term which may extend to six months or with fine which may extend to five thousand rupees or with both.

(2) Whoever having been convicted for an offence specified in sub-section (1) shall be guilty of any such offence, shall, notwithstanding anything contained in the Act under the provisions of which he is so convicted, be punishable for every such subsequent offence with imprisonment for a term which may extend to one year or with fine which may extend to ten thousand rupees or with both.

3. Saving:- Notwithstanding anything contained in any other Saving. law for the time being in force, it shall be lawful for any Magistrate of the first class and for any Presidency Magistrate to pass a sentence of fine exceeding one thousand rupees on any person convicted of any offence which has been made punishable with enhanced fine by this Act.
