THE WEST BENGAL PREMISES RENT CONTROL (TEMPORARY PROVISIONS) (BARRACKPORE AND TOLLYGUNCE) (VALIDATION) ACT, 1955

An Act to validate certain matters relating to the application of the West Bengal Premises Rent Control (Temporary Provisions) Act, 1950, in Barrackpore and Tollygunge.
It is hereby enacted as follows :-
1. Short title. - This Act may be called the West Bengal Premises Rent Control (Temporary Provisions) (Barrackpore and Tollygunge) (Validation) Act, 1955.
2. Definitions. - In this Act, unless the context otherwise requires, -
(a) "the Act" means the West Bengal Premises Rent Control (Temporary Provisions) Act, 1950 as in force for the time being and includes the rules made thereunder;
(b) "Tollygunge" means the area formerly comprised within the Municipality of Tollygunge which has been included within Calcutta, as from the 1st day of April, 1953 by notification under section 594 of the Calcutta Municipal Act, 1951;
(c) expressions used in this Act and not otherwise defined have the same meaning as in the Act.
3. Validation. - (1) Notwithstanding any defect in law, Shri B.K. Shome, Sub-Deputy Magistrate and Sub-Deputy Collector, shall be deemed to be and to have always been the Controller for the Barrackpore sub-division of the 24-Parganas district for the period between the 8th day of January, 1951 and the 8th day of April, 1953, both days inclusive.
(2) Notwithstanding the inclusion of Tollygunge within Calcutta, as from the 1st day of April, 1953, by notification under section 594 of the Calcutta Municipal Act, 1951, the Controller for the Sadar sub-division of the 24-Parganas district shall be deemed to be and to have always been as competent to deal with cases filed and deposits of rent made with him under the Act before the expiry of the 31st day of March, 1954 in respect of premises in Tollygunge, as if Tollygunge had never been included in Calcutta.
