Uttarakhand Agriculture Produce e-trading Mandi Area Licence Rules, 2016
No. 965/13/40(1)/2014, dated 20.12.2016, published in the Uttarakhand Gazette, Extraordinary, Part 4 Section (Ka), dated 20.12.2016, pp. 3-5. - In exercise of the power conferred by clause (forty) of sub-section (1) and sub-section (2) of Section 93 of Uttarakhand Agriculture Produce Mandi (Development and Regulation) Act, 2011, the Governor is pleased to promulgate. The Uttarakhand Agriculture Produce e-trading Mandi Area Licence Rules, 2016 for the purpose of e-trading in Mandi area as follows -
CHAPTER 1
Preliminary
1. Short title, extent and commencement. - (1) These rules may be called the Uttarakhand Agriculture Produce e-trading Mandi Area Licence Rules, 2016.
(2) It shall extend to the whole State of Uttarakhand.
(3) It shall come into force at once.
2. Definitions. - (a) "Act" means the Uttarakhand Agriculture Produce Mandi (Development and Regulation) Act, 2011.
(b) "Licence Holder" means such commission agent, broker or agencies who in general course of business, whether in cash or kind, manages the things or contracts of sale or purchase of agriculture produce on behalf of his owner, but not include servants of such owners inspite of him managing the things of such contracts.
(c) "Trader" means a person buying or selling a notified product during the course of his general trading works, it includes person who processes any agriculture produce but does not include a farmer.
(d) All words and expressions used and not defined here in, but defined in the Uttarakhand Agriculture Produce Mandi (Development and Regulation) Act, 2011 shall have the same meaning assigned to them in the said Act.
3. Registration on Portal. - In case of any licence holder or trader willing to e-trade under Section 27(a) of the Act, he shall be required to register himself on e-trade portal of the Uttarakhand Agriculture Produce Marketing Board.
4. Qualification for Registration. - Registration for e-trade may be made only of such licence holders or traders who are already holding licence for general trade in any Mandi Society.
5. Login ID and Password. - On registration, he will receive a login and password to the portal through e-mail. He may be able to change the password by making use of the facility available on portal.
6. Licence to e-trade. - After connecting to portal through log in ID and password and using digital signature a license will be obtained for e-trading in Mandi areas of all agriculture produce Mandi Societies of Uttarakhand and no other licence shall be required separately.
