THE TRANSFER OF LAND (VALIDATING) ACT, 2011 (1954 A. D.)

(Act No. XXVI of Svt. 2011)

    An Act to validate certain transfers of lands made prior to 30th of Har, Samvat 2007.

    Whereas sub-section (3) of section 19 of the Poonch Alienation of Land Regulation, 1991, required that no instrument relating to alienation of land registered under the provisions of the said Regulation, shall be considered valid unless and until it was duly countersigned by Sri Raja Sahib of Poonch ; and

    Whereas a large number of such instruments registered prior to 30th day of Har, Svt. 2007, when proprietary rights were conferred on landlords in Poonch, have not been countersigned in accordance with the aforesaid provision owing to delegation of the authority of Sri Raja Sahib of Poonch not having been clearly defined ; and

    Whereas it is necessary to remove doubts as to the validity of such instruments ;

It is hereby enacted as follows :—

1. Short title.—This Act may be called the Transfer of Land (Validating) Act, 2011.

2. Validation of certain transfers made prior to 30 Har, 2007.— Notwithstanding anything contained in sub-section (3) of section 19 of the Poonch Alienation of Land Regulation, 1991, an instrument relating to alienation of land as defined in the said Regulation registered prior to the thirtieth day of Har, Samvat 2007, when proprietary rights were conferred on land-holders in Poonch, shall not be deemed to be invalid by reason only that it had not been so countersigned as required by the aforesaid sub-section.
