In exercise of the powers conferred by rule-15 of the Bihar Secretariat Clerical Service Rules, 2006, the State Government of Bihar Personnel and Administrative Refoms Department) hereby makes the following regulations for determination of common seniority list in the secretariat clerical service in the light of Rule-2(h) and 13 of the said Rules -
1.Short title and commencement - (i) These regulations may be called "The Bihar Clerical Service (common seniority list) Regulations, 2008."
(ii) It shall come into force at once.
2. Definitions - In these regulations, unless the context otherwise requires
(i) "Rules means "The Bihar Secretariat Clerical Service Rules, 2006"; and
(ii) Words and references used in these regulations but not defined in these regulations, shall have the same meaning as referred in the Rules
3. Preparation of common seniority list:-
The procedure for determination of the inter-se-seniority. employees of the service, appointed and working in Secretariat and its attached offices, whose services are confirmed, shall be as under :
(a) Lower Division Clerk
Inter-se seniority of lower division clerks, of the service, shall be maintained department wise separately. by the concerned departments, in accordance with the provisions laid down in Rule 11 of the Rules.
(b) Upper Division Clerk :
The inter-se-seniority of the employees automatically observed in the upper division clerk grade shall be determined from date of their initial regular appointments. The inter-se seniority of the employees promoted in Upper Division Clerk Grade under rule 12 (1) and (2) shall be determined according to their date of promotions. If the date of promotion being same the seniority shall be determined on the basis of higher pay drawn, followed by pay in higher scule and then followed by the basis of age.
