THE SOCIETIES REGISTRATION (ASSAM SECOND AMENDMENT) ACT, 1948
ASSAM ACT XV OF 1948
Act further to amend the Societies Registration Act, 1860, in its application to Assam
Preamble:- WHEREAS it is expedient to amend further the Societies Registration Act, 1860 (hereinafter referred to as the said Act) in its application to the Province of Assam, in the manner hereinafter appearing :
It is hereby enacted as follows :
1. Short title, extent and commencement:- (1) This Act may be called the Societies Registration (Assam Second Amendment) Act, 1948.
(2) It extends to the whole of the Province of Assam.
(3) It shall come into force at once.
2. Amendnent of section 13 of Act XXI of 1860:- (1) In section 13 of the said Act,-
(a) after the words "as the governing body" the words "or special Committee formed to replace the governing body in respect of all matters affecting the winding up of the affairs of the Society ;" shall be inserted ;
(b) after the words " the said governing body" the words "should it not have been replaced by the aforesaid special Committee in respect of nil matters affecting the winding up of the Society, or the said special Committee," shall be inserted.
(2) After section 13 of the Act, the following proviso shall be inserted as the first proviso , namely:-
Provided that any matter decided by three-fifths of those presefl.t either in person or by proxy at any meeting of the members of the Society or of the governing body thereof or of any special Committee appointed at a General Meeting for the purpose of winding up of the affairs of a Society shall not be deemed to be a matte.r of dispute within the meaning of this section.
3. Amendnent of section 14 of Act XXI of 1860:- In section 14 of the said Act, after the words "some other Society," the words "whether registered under this Act or not " shall be inserted.
4. Repeal of the Societies Registration (Assam Amendment) Ordinance, 1948:- (1) The Societies Registration (Assam Amendment) Ordinance, 1948, is hereby repealed.
(2) Any order and anythmg done under the said Ordinance and in force immediately before the commencement of this Act shall continue in force and be deemed to be made and done under the corresponding provisions or this Act.
