THE SHILLONG (EXECUTION OF DECREBS ) ACT, 1943
ASSAM ACT XII 1943
An Act to provide the Civil Courts having jurisdiction over tile British portion of Shillong with the power tu send decrees for execution to the Civil Courts having jurisdiction in the Khasi States, and also power to execute decrees sent to themfor execution by tile Civil Courts having jurisdiction in the Khasi Stalls.
Preamble:- WHEREAS it is expedieut to provide that the Civil Courts having jurisdiction over the British portion of Shillong shall have power to send decrees for execution to the Civil Courts having jurisdiction in the Khasi States, and also power to execute decrees sent to them for execution by the Civil Courts having jurisdiction in the Khasi States ;
It is hereby enacted as follows:-
1. Short title and commencement:- (1) This Act may be called the Shillong (execution of Decrees) Act, 1943.
(2) It shall come into force on such date as the Provincial Government may specify by Notification in the Official Gazette.
2. Definition:- In this Act, "Shillong" means the British portion of the Khasi and Jaintia Hills District, other than that declared to be a Partially Excluded area under the Government of India Excluded and Partially Excluded Areas Order, 1936.
3. Sending of decrees for execution to courts in the Khasi States:- Any decree passed by a Civil Court having jurisdiction in Shillong may be aent by such Court for execution to any Civil Court established or continued by the authority of the Central Government or the Crown Representative in the Khasi States.
4. Receiving of decrees for execu· tion from Couna an the Khasi States:- If any Civil Court having jurisdiction in Shillong receives for execution a decree from any Civil Court established or continued by the authority of the Central Government or the Crawn Representative in the Khasi States, it shall proceed to execute such decree, according to the provisions of any law or Rules relating to the execution of decrees to which it is, or may hereafter become, subject.
