Punjab State Commission for Scheduled Castes Act, 2004

THE PUNJAB STATE COMMISSION FOR SCHEDULED CASTES (AMENDMENT) ACT, 2016

(Punjab Act No. 35 of 2016)

    An Act further to amend the Punjab State Conmission for Scheduled Castes Act, 2004.

Bu it enacted by the Legislature of the State of Punjab in the Sixtyseventh Year of the Republic of India as follows:-

1. Short title and commencement:- (1) This Act may be called the Punjab State Commission for Scheduled Castes (Amendment) Act, 2016.

(2) It shall come into force on and with effect from the date of its publication in the Official Gazette.

2. Amendment in section 2 of Punjab Act 5 of 2004:- In the Punjab State Commission for Scheduled Castes Act, 2004 Amendment in section 2 of Punjab Act 5 of 2004. (hereinafter referred to as the principal Act), in section 2,-

(i) in clause (d), for the word "Chairperson", the words and signs "Chairperson, Senior Vice-Chairperson, Vice-Chairperson" shall be substituted:

(ii) inctause (f), the word "and" appearing at the end shall be omitted; and

(iii) in clause (g), for sign". ", the sign"; " shall be substituted and thereafter, the following clauses shall be added, namely:-

"(h) "Senior Vice-Chairperson" means Senior Vice- Chairperson of the Commission; and

(i) "Vice-Chairperson" means Vice-Chairperson of the Commission."

3. Amendment in section 3 of Punjab Act 5 of 2004:- In the principal Act, in section 3, in sub-section (2),-

(i) after clause (a), the following clause shall be inserted, namely:-

"(aa)a Senior Vice-Chairperson and a Vice-Chairperson, who shall be eminent persons belonging to Scheduled Castes, to be appointed by the Government;";

(ii) for clause (b/, the following clause shall be substituted, namely:

"(b) not more than ten non-official members from amongst the members of the Scheduled Castes, who may be appointed by the Government from amongst the persons of ability, integrity and standing, who have served for the welfare and upliftment of the Scheduled Castes:

Provided that Senior Vice-Chairperson and Vice-Chairperson shall be appointed by the Government from amongst the nonofficial members:

Provided further that out of ten non-official members, at least one shall be a woman;".
