THE PAYMENT OF WAGES (WEST BENGAL AMENDMENT) ACT, 1975

West Bengal Act XXVI of 1975

    An Act to amend the Payment of Wages Act, 1936, in its application to West Bengal.

    Whereas it is expedient to amend the Payment of Wages Act, 1936, in its application to West Bengal, for the purpose and in the manner hereinafter appearing;

It is hereby enacted as follows:-

1. Short title. - This Act may be called the Payment of Wages (West Bengal Amendment) Act, 1975.

2. Application of the Act. - The Payment of Wages Act, 1936 (hereinafter referred to as the said Act), shall, in its application to West Bengal, be amended in the manner hereinafter provided.

3. Amendment of section 7 of Act 4 of 1936. - In sub-section (2) of section 7 of the said Act, after clause (e), the following clause shall be added, namely:-

"(p) deductions for contribution to a fund created under a "Death Benefit Scheme" approved by the State Government and designed to render pecuniary assistance to the dependants of a deceased employed person who had been a member of such a scheme :

Provided that no deduction shall be made without written authorisation of the employed person in the form and manner prescribed in the scheme.

Explanation. - "dependant" has the same meaning assigned to it in clause (d) of sub-section (1) of section 2 of the Workmen's Compensation Act, 1923.".
