NOTIFICATION
NO.FEM(PC)22/88/16 – In exercise of the powers conferred to the proviso to Article 309 of the Constitution of India. The Government of Meghalaya hereby makes the following rules to amend the Meghalaya Civil Services (Pension) Rules, 1983 namely :-
1. Short title and commencement. (1) These rules may be called the Meghalaya Civil Services (Pension) (Third Amendment) Rules, 1991.
(2) They shall come into force at once.
2. Amendment of Rule 73 – In rule 73 if the Meghalaya Civil Services (Pension) Rules, 1983, after sub-rule (2), the following shall be added as sub-rule (3) namely –
“(3) Notwithstanding anything contained in sub-rules (1) and (2), where the accounts pertaining to a long term loan or advance maintained by the Audit Officer are incomplete due to reasons not directly attributable to the Government servant concerned and the property acquired through such loan or advance is mortgaged to the Government balance of such loan or advance, if any, due to Government shall not be deducted from the gratuity payable to him/his nominee or as the case may be, legal heir and in the event that the balance is not repaid it shall be open to Government to enforce at any time the security of the mortgage and recover the amount together with interest thereon and cost of recovery by sale of the property or by such other name as may be permitted under the law”.
“Illustration” : House building or house purchasing advance or motor car/cycle/scooter purchasing advance is long term loan or advance.
