THE KERALA STATE HOUSING BOARD ACT, 1971

(Act 19 of 1971)

    An Act to provide for tbe organised direction and planning in the preparation and execution of housing and improvement schemes and for the establishment of a State Housing Board in the State of Kerala

    Preamble.-WHEREAS It is expedient to provide for the organised direction and planning in the preparation and execution of housing and Improvement schemes and for the estabhshment of a State Housing Board in the State of Kerala ;

Be it enacted in the Twenty-second Year of the Repubhc of India as follows :-

CHAPTER I

PRELIMINARY

1. Short title, extent and commencemcnt.-(1) This Act may be called the Kerala State Housing Board Act, 1971.

(2) It extends to the whole of the Stale of Kerala.

(3) It shall be deemed to have come into force in the Trivandrum Taluk in Trivandrum District on the 5th day of March, 1971, and in the remaining areas in the Stale it shall come into force on such date as the Government may, by notification in the Gazette, appoint and different dates may be appointed for different areas.

2. Definitions.- In this Act, unless the context otherwise requires,-

(1) "betterment fee" means the fee declared to be payable under section 74 in respect of an increase in the value of land resulting from the execution of a housing or Improvement scheme ;

(2) "Board" means the Kerala State Housing Board constituted under section 4 ;

(3) "Board premises" means any premises belonging to, or vesting in, the Board or taken on lease by the Board or any premises which is entrusted to, or in the possession or control of, the Board or the purposes of this Act ;

(4) "Chairman" means the Chairman of the board ;

(5) "Committe" means any committe appointed under section 26 ;

(6) "Competent authority'' means any person or authority authonsed by the Government by notlfication in the Gat.clte, to perform the functions of the competent authority under Chapter XI for such area as may be specified in the notification ;

(7) "Housing Board Engineer" means the Housing Board Engineer appointed under section 17 ;
