THE KERALA JUDICIAL OFFICERS PROTECTION ACT, 1963

(Act 4 of 1963)

 An Act for the protection of officers acting judicially.

    Preamble.-WHEREAS It is necessary to unify the law relating to the protection of Judges, Magistrates, Collectors and other officers acting judicially ;-

BE it enacted in the Thirteenth Year of the Republic of India as follows:-

1. Short title, extent and commencement.-(1) This Act may be called the Kerala Judicial Officers Protection Act, 1963.

(2) It extends to the whole of the State of Kerala.

(3) It shall come into force at once.

2. Bar of suits against Judges, Magzstrates, Collectors and other persons acting judicially:- No Judge, Magzstrate, Collector or other person acting judicially shall be liable to be sued in any Civil Court, for any act done or ordered to be done by him in the discharge of his judicial duty, whether or not within the limits of his junsdiction , Provided that he at the time, in good faith, believed himself to have jurisc iction to do or order the act complained of, and no officer of any court or other peison, bound to execute the lawful warrants or orders of any such Judge, Magistrate, Collector, or other person acting judicially shall be liable to be sued in any Civil Court, for the execution of any warrant or order, which he would be bound to execute, if within the jurisdiction of the person issuing the same.
