THE JAMMU AND KASHMIR STATE EVACUEES’ (ADMINISTRATION OF PROPERTY) (VALIDATION OF ORDERS, PROCEEDINGS AND ACTS) ACT, 1958
(Act No. IV of 1958)
An Act to validate certain orders, proceedings and Act of S. Pritam Singh, Special Revenue Officer, Rajouri and the Settlement Officers, Poonch under the provisions of Jammu and Kashmir State Evacuees' (Administration of Property) Act, 2006.
Be it enacted by the Jammu and Kashmir state Legislature in the Ninth-Year of the Republic of India as follows :-
1. Short title. - This Act may be called the Jammu and Kashmir state Evacuees' (Administration of Property) (Validation of Orders, Proceedings and Acts) Act, 1958.
2. Validation of certain orders, proceedings and acts. - Notwithstanding anything contained in any law or judgement, decree or order of any Court, all orders made, proceedings taken and Acts done by S. Pritam Singh as Special Revenue Officer, Rajouri and Settlement Officer, Poonch, purporting to Act as additional Custodian in the District Poonch, Jammu during the periods commencing from the date of his appointment as Special Revenue Officer, Rajouri, and ending with the date of the publication of Cabinet Order No. 1430-C of 1955 dated 22nd September, 1955, and commencing with the date of his appointment as Settlement Officer, Poonch, and enjing with the date of publication of Cabinet Order No. 1355-C of 1956 dated 4th August, 1956, shall be deemed to be and always to have been validly made, taken or done and for the purposes of the Jammu and Kashmir State Evacuees' (Administration of Property) Act, 2006 and of any other law for the time being in force, all such orders, proceedings and acts shall be as good and valid as if a notification specially empowering the said Officer to exercise such powers as aforesaid had been issued by the Government under section 4 of the aforesaid Act.
3. Bar to suits and proceedings. - No suit or other legal proceedings shall lie, or, if instituted, shall be proceeded with, in any Court against the Government or any authority subordinate to it on account of or in respect of any such order validated by the provisions of the preceding section.
