THE JAMMU AND KASHMIR REGISTRATION OF DEEDS (VALIDATION) ACT, 1985

(Act No. IX of 1985)

    An Act to validate registration and authentication of certain documents made by Registrar/Sub-Registrar, Budgam.

Be it enacted by the Jammu and Kashmir State Legislature in the Thirty-sixth Year of the Republic of India as follows:-

1. Short title. - This Act may be called the Jammu and Kashmir Registration of Deeds (Validation) Act, 1985.

2. Validation of acts of registration purporting to have been done by Registrar/Sub-Registrar, Budgam. - All acts performed and documents registered by Registrar/Sub-Registrar, Budgam relating to the plots of land allotted by Government in Bemina-Barthana Housing Colony during the period from the 27th day of January, 1984 up to and including 27th day of February, 1984, shall be as valid and shall be deemed to have been as validly done as if the Registrar/Sub-Registrar, Budgam was competent to do so in accordance with the law relating to registration in force during the period specified.

3. Validation of the records of aforesaid document. - In particular and without prejudice to the generality of the acts validated by the foregoing provisions,-

(a) all documents registered by the aforesaid Registrar/Sub-Registrar during the period aforesaid shall be deemed to have been validly registered on the dates of their registration;

(b) all entries and indexes relating to the documents registered as aforesaid made in the Register Book in the manner provided by Part XI of the Jammu and Kashmir Registration Act, Samvat 1977 shall be deemed to have been validly made; and

(c) all copies of the aforesaid registered documents which have duly signed and sealed by the said Registrar/Sub-Registrar in the manner required by section 57 of the Jammu and Kashmir Registration Act, Samvat 1977 shall be admissible for the purposes of proving the contents of the original documents.

4. Protection for Registrar/Sub-Registrar acting bona fide as Registering Officer. - Notwithstanding anything contained in any law to the contrary, the Registrar/Sub-Registrar aforesaid shall not be liable in any suit or proceeding for any claim for damages or otherwise by reasons of anything in good faith done or refused by them while purporting to act as Registrar/Sub-Registrar aforesaid.

5. Saving. - Nothing contained in this Act shall affect the decision of a Court of competent jurisdiction which has become final before the commencement of this Act.

6. Repeal. - The Jammu and Kashmir Registration of Deeds (Validation) Ordinance, 1984 is hereby repealed.
