THE JAMMU AND KASHMIR REGISTRATION OF DEED (VALIDATION) ACT, 1976

(Act No. I of 1976)

    An Act to validate the registration and authentication of certain documents made by the Munsiffs, Mahore and Mendhar.

Be it enacted by the Jammu and Kashmir State Legislature in the Twenty-seventh Year of the Republic of India as follows :–

1. Short title. - This Act may be called the Jammu and Kashmir Registration of Deeds (Validation) Act, 1976.

2. Validation of Acts of certain officers purporting to act as Sub-Registrars. - All acts performed by Munsiff Mahore and Munsiff Mendhar acting or purporting to act as Sub-Registrar respectively of Mahore and Mendhar Sub-District formed under Notification SRO-635 dated 13th December, 1973, during the period intervening [7th August, 1975] and 19th December, 1973 both the dates inclusive, shall be valid and shall be deemed to have validly performed as if the said Munsiffs had been duly invested with powers of Sub-Registrar during the said period.

3. Validation of the records of documents registered by the Munsiffs aforesaid. - In particular and without prejudice to the generality of the acts validated by the foregoing provision-

(a) all documents registered by the Munsiffs aforesaid while purporting to act as Sub-Registrar in the Sub-districts and during the period aforesaid shall be deemed to have been validly registered on the dates of their registration;

(b) all entries and indexes relating to the documents registered as aforesaid made in the Register Book in the manner provided by Part XI of the Jammu and Kashmir Registration Act, 1977 shall be deemed to have been validly made; and

(c) all copies of the aforesaid registered documents which have been duly signed and sealed by the said Munsiffs in the manner required by section 57 of the Jammu and Kashmir Registration Act, 1977 shall be admissible for the purposes of proving the contents of the original documents.

4. Protection for Munsiffs acting bona fide as registering officers. - Notwithstanding anything contained in any law to the contrary, the Munsiffs aforesaid shall not be liable in any suit or proceeding for any claim for damages or otherwise by reasons of anything in good faith done or refused by them while purporting to act as Sub-Registrars as aforesaid.

5. Saving. - Nothing contained in this Act shall affect the decision of a Court of competent jurisdiction which has become final before the commencement of this Act.
