THE GOALPARA TENANCY (AMENDMENT) ACT, 1936

ASSAM ACT XIII OF 1936

An Act further to amend the Goalpara Tenancy Act, 1929.

    Whereas it is expedient further to amend the Goalpara Tenancy Act, 1929;

    And whereas the previous sanction of the Governor General, required by sub-section (3) of section BOA of the Government of India Act, has been obtained to the passing of this Act.

    It is hereby enacted as foUows :-

1. Short title:- This Act may be called the Goalpara Tenancy (Amendment) Act, 1936.

2. Amendment of section 8:- The words "within six months of the transfer" in section 8, sub-section (1) of the Goalpara Tenancy Act, 1929 (hereinafter referred to as the principal Act) shall be deleted.

The word "entertained" in section 8, sub-section (2) of the principal Act shall be replaced by the words " decreed or granted."

The entire sub-section (3) of section 8 of the principal Act shall be deleted.

3. Amendment of section 57:- The word "shall" in the sub-clause (ii) of the second proviso to sub-section (1) of section 57 of the principal Act shall be replaced by the word ' may ' and in the same sub-clause the words "at the rate mentioned in section 56" shall be replaced by the words ''at the rate the Court may direct".
