THE CIVIL PROCEDURE (ASSAM AMENDMENT) ACT, 1941
ASSAM ACT II OF 1941
An Act to amend the Code Of Civil Procedure, 1908.
Where it is expedient to amend Section 138 of the Code Of Civil Procedure, 1908 (Act V of 1908) in its application to Assam, in the manner hereinafter appearing;
It is hereby enacted as follows:
1. Short title. - This Act may be called the Code of Civil Procedure (Assam Amendment) Act, 1941.
2. Substitution of new section for Section 138 of Act V of 1908. - For Section 138 of the Code Of Civil Procedure, 1908 (Act V of 1908) in its application to Assam, the following section shall be substituted, namely:
"138. Power to High Court to require evidence to be recorded in English. - The High Court may, by notification in the official Gazette, direct with respect to any Judge specified in the notification, or falling under a description set forth therein, that in cases in which an appeal is allowed, he shall take down, or cause to be taken down, the evidence in the English language and in the form and manner prescribed."
