TIIE BODOLAND AUTONOMOUS COUNCIL (AMENDMENT) ACT, 1999

ASSAM ACT NO. XVI OF 1999

    An Act further to amend the Bodoland Autonomous Council Act, 1993.

    Preamble:- Whereas it is expedient further to amend the Bodoland Autonomous Council Act, 1993, hereinafter referred to as the principaI Act, in the 'manner hereinafter appearing ;

    It is hereby enacted in the Fiftieth Year of the Republic of India as follows:-

1. Short title, extent and commencement:- (1) This Act may be called the Bodoland Autonomous Council (Amendment ) Act, 1999.

(2) It shall have the like extent as the principal Act.

(3) It shall come into force at once.

2. Amendment of section 2:- In the principal Act, in section 2, after clause (0), the following clause shall be inserted; namely:--

"(P) "Commission" means State Election Commission, Assam Constituted vide Government Notification No.PDA.116/94/5 dated Dispur, May 31, 1994.

2. Amendment of section 3:- In the ptincipal Act, in section 31 in sub-section (1), between the words 'areas' and' 'as' the following shall be inserted; namely :--

"With special consideration in regard to Tribal Belts/Blocks, and areas falling within Reserved Forest."

4. Amendment of section 10:- (a) In the principal Act, in section 10, in sub-section (3), for the words "The Govemmenf', 'the words "The Commission" shall be substituted.

(b) In the principal Act, in section 10, after the existing sub-section (3), the following shall be· inserted as sub-section ( 4) thereto, namely :--

" (a) All powers relating to preparation of the electoral rolls in accordance with the provision of sub-section (I) for the conduct of elections to the General Council shall vest in the Commission."

5. Amendment of section 12:- In the principal Act, in section 12, for the word "direct" occurring between the words "may" and "in", the word "recommend" shall be substituted.

6. Amendment of section 15:- In the principal Act, in section 15, for the words "the Government", the words "the Commission" shall be substituted.

7. Amendment of section 19:- In the principal Act, in section 19, in clause (a), the words "the officer or authority who may prepare and maintain the electoral roll under section 10 occurring after the word "and" shall be substituted by the words "the manner in which the electoral roll under section 10 shall be prepared, published and maintained by the Commission."
