Bihar Civil Services (Judicial Branch) (Recruitment) (Amendment) Rules 2014

1. Short title, extent and commencement :- (i) These Rules may be called the "Bihar Civil Service (Judicial Branch) (Recruitment) Amendment Rules, 2014".
(ii) it shall extend to the whole of Bihar
(iii) It shall come into force from the date of issue of Notification.
2. Amendment of Rule-3 of the Bihar Civil Service Judicial Branch) (Recruitment) Rules, 1955 :- The following Rule-3B shall be added below Rule-3A of the said Rule:
"3B-3% reservation to disabled persons in accordance with the provision of General Administration Department Resolution no. 62 dated 05.01.2007 issued in the light of Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 shall also apply to direct recruitment to the post of Civil Judge Junior Division)."
3. Ammendment of Rule-4 of the Bihar Civil Service (Judicial Branch) (Recruitment) Rules, 1955 :- The following three proviso shall be added to Rule-4 of the said Rule:
"Provided that, if for any reason the Commission is not being able to hold the competitive examination for a particular year or years, it shall be open to the Commission to hold common competitive examination for a particular year or years for which competitive examination could not be held in that particular year or years:
Provided further that in the event of competitive examination being held for more than one year on requisition being made by the Government, it shall be open to the Commission to hold one competitive examination for a particular year or years and vacancies of particular year or years for which competitive examination could not be held in that particular year may be clubbed together for the purpose of preparation of merit list of successful candidates and in the event of common competitive examination held by the Commission, it shall not be necessary to prepare separate merit list for each recruitment year:
Provided further that if common competitive examination is being conducted for particular year or years as a special case, the applicant shall be entitled to relaxation of upper age limit provided such applicant was eligible in that particular recruitment year for which the common competitive examination is being conducted."
4. Amendment of Rule-10 of the Bihar Civil Service (Judicial Branch) (Recruitment) Rules, 1955 :- Rule-10 of the said Rules shall be substituted by the following:
"10- Candidates must pay to the commission examination fee as prescribed by the State Government
5. Amendment of Rule-15 (c) of the Bihar Civil Service (Judicial Branch) (Recruitment) Rules, 1955 :- Rule-15 (c) of the said Rules shall be substituted by the following:
"15 (C)- There shall be a qualifying marks of 35% for the viva-voce test."
6. A new Rule-28 shall be added after Rule-27 of the Bihar Civil Service (Judicial Branch) (Recruitment) Rules, 1955:-
"28-Over-riding effect of these Rules - Notwithstanding contained anything contrary to these Rules in any other Rules Orders or executive instructions, the provision regarding above amendment in the said Rules shall have over-riding effect."
